USER GOVERNANCE & SERVICE AGREEMENT

PREAMBLE

This digital environment is managed by SAM DAIGLE. Across this platform, references to "the Provider," "we," or "our" designate SAM DAIGLE. Access to this domain, its utilities, and all associated commercial offerings is granted to you (the "Participant") strictly on the condition that you adhere to every protocol, directive, and notice documented herein.

By engaging with our platform or finalizing a transaction, you enter into our "Operational Framework" and commit to the mandates of this User Governance Agreement ("Rules of Engagement"). These stipulations apply to every individual interacting with the site, including casual visitors, commercial partners, and content contributors.

Mandatory Review: Please analyze these directives before utilizing our digital assets. Entry into any portion of this site constitutes a binding acknowledgment of these rules. If these standards are unacceptable to you, you are prohibited from accessing the platform or utilizing its resources.

ARTICLE 1: ELIGIBILITY & CONDUCT

By engaging on this platform, you affirm that you have reached the age of legal majority in your specific jurisdiction. If you are a parent or guardian, your authorization of a minor’s access implies your full assumption of liability for their conduct.

Global Compliance: International users acknowledge that their participation must align with the statutes of their home nations. You bear the exclusive burden of adhering to all cross-border trade, currency, and tax obligations. Any breach of these standards will trigger an immediate revocation of access.

ARTICLE 2: OPERATIONAL DISCRETION

The Provider maintains an absolute right to withhold participation from any entity at any moment. You acknowledge that non-financial data may be transmitted across unshielded networks to meet technical hardware requirements; however, payment card data is perpetually shielded via encryption during transit.

Intellectual Property Protection: Reproduction, mirroring, or commercial exploitation of any element of this system—or the contact pathways provided within—is strictly forbidden without a formal, written license issued by the Provider.

ARTICLE 3: DATA INTEGRITY & UPDATES

We provide the material on this platform for general awareness. We do not guarantee that the provided insights are exhaustive or current. Decisions should not be predicated solely on this content; doing so is at your own peril. We reserve the right to modify the platform’s landscape at our discretion, though we are under no mandate to refresh obsolete data. It is your obligation to monitor the platform for structural or policy shifts.

ARTICLE 4: FINANCIAL & SERVICE ADJUSTMENTS

Pricing structures are fluid and may be altered without prior notification. We maintain the authority to suspend or terminate any segment of our offerings at any time. We are not liable to you or any secondary party for any price adjustments or the cessation of specific features.

ARTICLE 5: PROPRIETARY OFFERINGS

Certain items or experiences may be restricted to digital acquisition. These may be produced in limited runs and are governed by our specific Reimbursement Protocols. While we strive for visual accuracy regarding product aesthetics, we cannot account for the calibration of your personal hardware displays.

We may, at our discretion, restrict the distribution of our assets based on geography or individual standing. Descriptions and valuations of all assets are subject to immediate change without notice.

ARTICLE 6: TRANSACTIONAL VERACITY

The Provider reserves the right to decline or void any request for acquisition. We may limit volumes per household or per digital identity. If an order is modified or rescinded, we will attempt notification via the contact data provided. We strictly prohibit acquisition by entities we deem to be resellers or third-party distributors. You are obligated to maintain current and precise account credentials to ensure seamless logistics.

ARTICLE 7: EXTERNAL UTILITIES & LINKS

We may grant access to ancillary third-party tools. You acknowledge that these are provided "As Available" without endorsement or safety guarantees. Use of such tools is entirely at your own risk. Similarly, our platform may contain conduits to external sites. We do not audit, nor are we responsible for, the content or accuracy of external entities.

ARTICLE 8: RESTRICTED ACTIVITIES

In addition to standard legal prohibitions, you are forbidden from utilizing the platform or "THE GAME" to:

  • Promote or execute illegal acts.
  • Infringe upon the intellectual property of the Provider or others.
  • Engage in discriminatory, harassing, or defamatory conduct.
  • Deploy malicious code or bypass security protocols.
  • Harvest the data of other Participants.
  • Jurisdictional Clause: Any behavior that violates the laws of your specific physical location—regardless of whether those laws are actively policed—is a material breach of this agreement.

ARTICLE 9: INDEMNITY & LIMITATION OF FAULT

The Provider does not promise an error-free or perpetual experience. Your participation is "At Your Own Risk." SAM DAIGLE, along with associated officers and agents, shall not be held liable for any damages—direct, incidental, or consequential—arising from your interaction with our Services. This includes, but is not limited to, loss of revenue or data.

Indemnification: You agree to shield and defend SAM DAIGLE from any legal claims or financial demands (including legal fees) arising from your violation of these standards or the rights of any third party.

ARTICLE 10 - VOLUNTARY ASSUMPTION OF RISK & PARTICIPANT CONDUCT

  • 10.1 Nature of The Game: By participating in "The Game" or any associated challenges, the Participant acknowledges that such activities may involve physical movement, navigation of public or private spaces, and interaction with the physical environment. The Participant voluntarily chooses to engage in these activities with full knowledge of the risks involved.
  • 10.2 Explicit Assumption of Risk: The Participant assumes all responsibility for any risk of property damage, personal injury, or death arising from their participation. This includes, but is not limited to, risks associated with:
    • Travel to and from various locations.
    • Interaction with third parties or the public.
    • The physical condition of any location visited during a challenge.
    • Weather conditions or natural hazards.
  • 10.3 Personal Responsibility for Safety: It is the Participant’s sole responsibility to ensure their own safety and the safety of others. You agree to:
    • Obey all laws, traffic laws, trespassing statutes, and local ordinances.
    • Refrain from entering dangerous or restricted areas.
    • Exercise common sense and maintain situational awareness at all times.
    • Abstain from any conduct that could be deemed reckless or hazardous.
  • 10.4 No Supervision: The Participant acknowledges that SAM DAIGLE does not provide on-site supervision, security, or medical assistance for "The Game." The role of the Provider is limited to the digital dissemination of challenges. The Provider does not vet the safety of specific destinations or locations chosen by the Participant in the course of play.
  • 10.5 Release of Liability: To the maximum extent permitted by law, you hereby release, waive, and forever discharge SAM DAIGLE from any and all liability, claims, or causes of action arising out of your participation in "The Game," even if caused by the negligence of the Provider or any associated parties.

ARTICLE 11: LEGAL STANDING & DISSOLUTION

  • Severability: If any clause here is deemed legally invalid, the remainder of the agreement remains in full force.
  • Termination: You may end this agreement by ceasing all use of the platform. We may terminate your access immediately if we suspect a failure to comply with these terms.
  • Governing Law: This agreement is anchored in the statutes of the State of Delaware and the federal laws of the United States.
